Introduction
This document sets out the terms and conditions that govern your use of the In-Stock? mobile application and online Platform presented by Stockchecker Pty Ltd.
These terms and conditions are updated as at November 2025.
User agreement
In this User Agreement, “You” or “Your” refer to you, as a User of the Platform and “We” or “Our” refers to Stockchecker Pty Ltd trading as In-Stock? mobile application, (“In-Stock”).
Please read these terms and all Policies including the Privacy Policy carefully before using the Platform. These Policies are incorporated into this Agreement by reference.
By using the Platform you are accepting and agreeing to the following terms and conditions.
All defined terms in this Agreement have the meaning given to them in the In-Stock Glossary.
In-Stock services
Basic principles
- In-Stock is a Platform that enables Users to post a Stock Check Task or Stock Check and Place on Hold Task.
- A Stock Check Task is a request by one User (Customer) for the services of another User (Service Provider) to check the availability of stock that a Customer has posted in a Stock Check Task.
- A Place on Hold may result from a Stock Check Task, or may be an independent task requesting the item to be put on hold or attempted to put the item aside with staff or check out desk or customer service desk or other available options.
- A Service Provider may elect to perform a service upon reviewing the Stock Check Task or Place on Hold Task.

The Platform also enables Customers and Service Providers to interact in order to:
- Provide recommendations as to alternative products where stock is not available.
- Notify of changes to pricing and sales of stock.
- Communicate or clarify in general.
Stock check function
- A Customer posts a Stock Check Task by listing a product on the Platform that they would like to Stock Check for a $2 plus fees cost. The cost is withdrawn from the Customer’s account via a Stripe portal.
- A Service Provider can browse Tasks on the Platform that are posted by Customers.
- Once a Service Provider has accepted a Stock Check Task, they have 30 minutes to fulfil the Task. There is an extension of time available.
- If the Stock Check Task is not fulfilled in the 30-minute time period, or if extended by that time extended, the Task will be re-posted on the Platform, upon confirmation with the Customer, for another Service Provider to perform.
- In-Stock is not responsible for any loss caused in circumstances where a Task is accepted but not performed or is reallocated in accordance with clause above.
- Once a Stock Check Task is posted, it cannot be modified by the Customer, if it has been selected by a service provider.
- If a Stock Check Task is incorrectly posted, the Stock Check fee will still be payable when the Service Provider performs the Task.
- However, the Customer and Service Provider are encouraged to communicate through the Platform and the Customer may request an amendment to the Task.
- It is at the Service Provider’s discretion to perform a modified check for free, in acceptance of the initial payment.
- Alternatively, the Customer may post another Stock Check Task, incurring the Service Fee again.
- In order to complete the Stock Check Task, the Service Provider is to confirm with the Customer a) the availability of the product, and if available, b) the price of the product. Upon providing a) and b), the Customer marks the Task as complete.
- It is at the Service Provider’s discretion to communicate if an alternative product is available when the product the subject of the Stock Check Task is not available.
- The Stock Check fee is withdrawn from the Customer’s account on the Platform upon posting of the Task and is transferred to the Service Provider on completion of the Task. If successfully cancelled, the balance after platform fees, is returned to the Customer’s account. This amount may be reduced by the fee and may not be refunded in entirety.
- All payments for a Stock Check are conducted through the Platform’s Payments System.
Place on hold function
- Once a Stock Check is performed a Customer can elect to mark the Task as complete or to proceed to a Place on Hold Transaction.
- If the Customer elects to proceed to the Place on Hold Transaction, the Service Provider that performed the Stock Check Task can elect to perform the Task.
- If the Service Provider declines the Place on Hold Transaction in accordance with instructions provided on the Platform, the system returns the job to the Platform for other Service Providers to perform. There may be circumstances where the Customer will have to repost a new Stock Check and Place on Hold or a Place on Hold Transaction which will be made available on the Platform for other Service Providers to perform.
- There is a $2 plus fee payment associated with the listing of a Place on Hold Transaction.
- There is a $4 plus fee payment associated to both Transactions.
- For a Place on Hold Transaction, the Service Provider and Customer will communicate on the Platform to agree on the method of placing the item on hold with the customer service staff at the store or come to an alternative. However if this option is completely unavailable at the store, it is still a valid transaction as the item is deemed unavailable to be placed on hold. In this scenario the Service Provider should be remunerated for their time to check this option out for the Customer.
- A posted Place on Hold Transaction does not guarantee that a Stock Check has been completed on the product.
- A Customer may post a Place on Hold Transaction Task without having first posted a Stock Check task on the same product.
- A Customer can also elect to do both at the same time when selecting Stock Check and Place on Hold. However there is no guarantee that the two tasks are done at the same time as the task may be declined by the Service Provider.
- A Service Provider that has not performed a Stock Check should view the product and confirm product match and price prior to accepting a Place on Hold Task.
- If a Service Provider cancels a Place on Hold Transaction that they have accepted prior to completion it is in the Customer’s discretion to give a negative review of the Service Provider (see Section, Reviews).
- Where a Place on Hold Transaction is cancelled by the Service Provider prior to completion, the job can be reallocated to the pool of service providers without incurring a charge. There may be opportunity to get the job cancelled and refunded, however the refund will be less the platform fees.
In-Stock’s role and obligations
- In-Stock only provides the Platform. We exclude all express or implied warranties or conditions of title, merchantability, use or fit for a particular purpose in relation to any products the subject of a Stock Check Task or a Place on Hold Transaction Task.
- In-Stock accepts no liability for any loss of money, feedback reputation, or any special, indirect or consequential damages arising, directly or indirectly, out of the use of, or inability to use the Platform.
- In-Stock accepts no liability for any aspect of the Customer and Service Provider negotiations and interactions, including but not limited to the description, accuracy, content, authenticity of goods, action or inactions, or delivery of goods and services.
- In-Stock is not a party to the transactions between Customers and Service Providers arising from any Stock Check Task or Place on Hold Transaction Task.
- In-Stock does not guarantee that the service provided by a Service Provider is provided with due care and skill, fit for any specified purpose (express or implied) or will be provided within a reasonable time.
- In-Stock does not take legal ownership of any products at any time in respect of any Stock Check Task or Place on Hold Transaction Task or otherwise.
- In-Stock has no obligation to any User to assist or involve itself in any dispute between Users, although may do so solely in its own discretion.
- In-Stock only permits individuals over 18 years old to become Users. Users must be natural persons but can represent a business entity. By creating an account to use the Platform You represent to Us that you as the account holder are over 18 years of age.
- In-Stock may refuse to allow any person to register or create an account or cancel or suspend or modify any existing account if it is in breach of these terms or is detrimental to the Platform. This is at In-Stock’s absolute discretion.
- In-Stock does not undertake any investigation in relation to any User before they are admitted to the Platform, including criminal checks, verification of age or other checks.
- You agree to assume all risks and you agree to expressly release and indemnify In-Stock for any and all loss, liability, injury, death, damage, or costs arising or in any way related to the services, provision of services or delivery of goods and/or services.
User obligations

You will at all times:
- comply with this Agreement (including all Policies) and all applicable laws and regulations;
- only post accurate information on the Platform, as a Customer and/or as a Service Provider;
- ensure that you are aware of any laws that apply to you as a Customer or Service provider, or in relation to using the Platform.
- You confirm that you are an individual over 18 years of age. Users must be natural persons, or otherwise represent a business entity. Users must have a valid account on the Platform and this includes being validated by Stripe in the Platform.
- You must not use the Platform for any illegal or immoral purpose.

You agree that any information posted, including reviews must not, in any way whatsoever be:
- potentially or actually harmful, misleading or deceptive;
- defamatory, libellous, threatening, abusive or harassing;
- to a User or to In-Stock.
- You must not interfere in the operation and proper workings of the Platform and bring damage to the program through viruses, hacking activities and other technologies.
- You must not copy, reproduce, modify, create derivative works from, distribute any content from the Platform.
- As the Customer, you must deliver payment for tasks that you request to be performed for you.
- You must not act fraudulently.
- You must not be involved in the sale of counterfeit or stolen products.
- You agree that any content on In-Stock may not be used on third party sites or for other business purposes.
- You grant In-Stock an unrestricted, worldwide, irrevocable, royalty-free licence to use, reproduce, and adapt any information posted for promotion purposes including in the Platform, in published material, online or social media.
- As a Service Provider, you may need to ask about or become familiar with store policies regarding trying to place an item on hold or placing it with customer service desk or checkout desk. You should communicate these to the Customer in fulfilling your task. If the store does not allow this put on hold practice to occur, you should communicate this to the Customer and be paid for your time and effort to initiate this.
- In-Stock is not responsible for non payment between parties on Customer or Service Provider side.
- When you enter into a transaction you create a legally binding contract with another User. You must ensure that you comply with your obligations to that other member and are aware of any laws relevant to you as a Customer or Service Provider. If another member breaches any obligation to you, you are responsible for enforcing any rights that you may have.
Fees
- Creating an account on the Platform is free.
- In-Stock does charge fees for the posting of Stock Check Tasks and Place on Hold Transaction Tasks. This covers the platform cost and the costs from using Stripe services.
- These fees may change and best efforts will be made to notify Users from time-to-time. A fee will be charged on the Customer requests and a fee will be charged on the Service Provider side to withdraw funds to an external bank account. These fees may be borne by the Customer, Service Provider or Platform in any combination as notified on the Platform from time-to-time. All funds after fees, besides charity contribution funds (see Charity Contribution) go to the Service Provider or in some cases may be refunded in full or partially to the Customer.
- Users must have an account. Further service providers must be connected to a Stripe account for payment of services. Stripe verifies each User so that they can interact with payments.
- The platform automatically pays out Service Provider Users monthly, if the balance is over a set minimum. This is currently set at $4 as there is a $3 fee charged to each User to be paid out.
- The cost of posting a Stock Check Task or a Place on Hold Task is $2 plus fee of 50 cents, per check. The cost of posting a combined Stock Check and Place on Hold Task is $4 plus fee of 80 cents. This charge will be withdrawn from the Customer’s account upon posting a Stock Check or Place on Hold Task, and paid directly to the Service Provider’s account upon completion of the Task after fees. The Service Provider may receive less than the $2 because of fees.
Charity contribution
- Upon completion of a Stock Check Task or a Place on Hold Task, a Service Provider can elect to contribute to charity, the $2 Service Fee earned from the performance of a Task rather than accept the fee into their account.
- This contribution is not tax deductible to users and a tax receipt will not be provided.
- The charitable purpose of these funds is to support programs that help Autistic people and their families.
- In-Stock through its holding company Stockchecker Pty Ltd has an authority to fundraise letter from Autism Spectrum Australia (Aspect) located at Level 5, Tower B, 821 Pacific Highway, Chatswood (ABN 12 000 637 267) to conduct fundraising on their behalf.
- The organiser is Stockchecker Pty Ltd and the beneficiary is Aspect.
- Charitable fundraising in different states of Australia vary. This contribution will be raised under NSW Charitable Fundraising Act and NSW Fair Trading, with the authority to fundraise in NSW.
- The contribution to charity is optional and if you do not agree to these terms, consider a direct donation via Autism Spectrum Australia (Aspect) website or do not contribute.
- In-Stock is not responsible to refund a User if the election to Contribute to Charity was made incorrectly.
Payments and refunds
- In-Stock is not obliged to provide refunds to Users in any circumstances, including where the Stock Check Task or Place on Hold Task has failed to complete for any reason.
- In-Stock is not responsible, nor will it indemnify any User, where a refund is not available.
- The Australian Consumer Law (ACL) applies between Users and Service Provider, and do not involve In-Stock, its Platform, or any of its officers, directors, agents, subsidiaries, joint venturers or employees.
- Communication between Users on the Platform is encouraged throughout the performance of a Task.
Reviews
- Upon completion of Tasks, Users are encouraged to review other Users on the Platform for the quality of services performed, or the non-performance of services.
- In-Stock is entitled to suspend or terminate your account at any time if In-Stock, in its sole and absolute discretion, deems any review made by you to be contrary to any law or otherwise misleading or defamatory, or otherwise considers your feedback rating to be improper in the circumstance of the underlying Task.
Payment facility
- In-Stock through its legal entity Stockchecker Pty Ltd uses a payments system using Stripe.
- Each user must have an account and Service Providers must have a Stripe account to use the Platform.
- The Platform charges a fee to a Customer User. The service provider will receive the balance after this fee. Currently this fee is approximately 50 cents or 80 cents for a combined transaction.
- When a Service Provider User is paid out, which is a transfer out of their Stripe account to an external bank account, a fee is charged. Currently this fee is about $3 per payout. This process is automatically initiated when their balance is at least over $4.
- There is a minimum balance imposed before a Service Provider User can be paid out, which is $4.
- Stripe is a secure payment service that uses encryption to secure all transactions.
- Stripe’s Services Agreement is fully incorporated into this Agreement and can be viewed here: stripe.com/en-au/ssa.
Limitation of liability
- In-Stock accepts no liability for any Loss or Consequential Loss arising, directly or indirectly, out of the use of, or inability to use the Platform.
- In-Stock accepts no liability for any Loss or Consequential Loss arising, out of or in connection to any claims made by third persons in relation to the use of the Platform.
- In-Stock accepts no liability for any aspect of the Customer and Service Provider negotiations and interactions, including but not limited to the description, accuracy, content, authenticity of goods, action or inactions, or delivery of goods and services.

To the extent that In-Stock is able to limit the remedies available under this Agreement, In-Stock expressly limits its liability for breach of a non-excludable statutory consumer guarantees (under the Australian Consumer Law) to a selection (in its sole discretion) from the following remedies:
- the supply of the services again; or
- the payment of the cost of having the services supplied again.
- Subject to any agreement to the contrary, the liability of each party to the other is capped at the Agreed Price being $2 plus fees or maximum $4 plus fees.
Release
- If you have a dispute with one or more Users, you agree to release In-Stock (and its officers, directors, agents, subsidiaries, joint venturers and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
Breach

In-Stock may, without notice to you and in its sole discretion, delay listing your post, delete your post, issue you a warning, restrict your activities on the Platform, temporarily suspend, indefinitely suspend or terminate your account and refuse to provide services to you, or require you to pay additional fees if:
- You have, or we believe that you have, breached this Agreement, which includes any of our Policies in any way;
- You have, or we believe that you have, breached the conditions of the Payments System Terms of Use (see Stripe’s Service Agreement fully incorporated by Section, Payment Facility) with In-Stock;
- We believe that your actions may cause loss or damage, or otherwise unlawfully harm you, our Users, third parties, us, or our related bodies corporate or affiliates, our directors employees or agents; or
- If we reasonably believe that any of your information or actions are inappropriate or of an offensive nature.
- For security, confidentiality and privacy reasons, we are not obligated to provide you or other Users the details of any investigation that we conduct or any action which we take, in relation to your account other than those that are already provided to you by us.
Privacy
- In-Stock does not provide your personal information to third parties for marketing purposes without your explicit consent.
- All personal information that you supply in connection with the Platform will be collected, used, disclosed and managed by In-Stock in accordance with In-Stock’s Privacy Policy as separately disclosed.
- By using the Platform, you consent to In-Stock dealing with your personal information in accordance with the Privacy Policy.
No agency
- No agency, partnership, joint venture, employee-employer or other similar relationship is created by this Agreement or use of the Platform. In particular, you have no authority to bind In-Stock, its related entities or affiliates in any way whatsoever.
- To the extent permitted by law, In-Stock specifically disclaims all liability for any loss or damage incurred by you in any manner due to the performance or non-performance of Services.
Notices

Notices must be given by registered post to In-Stock’s principal place of business address Stockchecker Pty Ltd, Level 3, 150 St Georges Terrace, Perth WA 6000, or by email to info@stockchecker.com.au. Any notice shall be deemed given:
- If sent by email, 24 hours after email is sent, unless the User is notified that the email address is invalid or the email is undeliverable, and;
- If sent by pre-paid post, three Business Days after the date of posting, or on the seventh Business Day after the date of posting if sent to or posted from outside the jurisdiction in which you have your Platform account.

Notices related to User performance must be served to the email address they have provided on their Platform account, or to the address they have provided during the In-Stock’s registration process.
- If sent by email, 24 hours after email is sent, unless the User is notified that the email address is invalid or the email is undeliverable, and;
- If sent by pre-paid post, three Business Days after the date of posting.
Dispute resolution
- In-Stock encourages Users to try and resolve disputes (including claims for returns or refunds) with other Users directly.
- If a dispute arises with another User, you must co-operate with the other User and make a genuine attempt to resolve the dispute.
- In-Stock will not assist Users to resolve disputes, nor does In-Stock refer Users to third party dispute services.
- In-Stock is not liable for any costs, losses or liabilities incurred by Users caused by a dispute, or by the resolution of a dispute, whether incurred by Users or third party dispute services.
- If you have a complaint about the Platform, please contact info@stockchecker.com.au.
Termination
- Either you or In-Stock may terminate your account and this Agreement at any time for any reason.
- Termination of this Agreement does not affect any Task Contract that has been formed between In-Stock Users.
- Sections “Fees”, “Limitation of Liability” and “Dispute Resolution” and any other terms which by their nature should continue to apply, will survive any termination or expiration of this Agreement.
General
- In-Stock? is the legal entity Stockchecker Pty Ltd and is located at Level 3, 150 St Georges Terrace, Perth WA 6000, Australia.
- Stockchecker Pty Ltd (ABN 50 629 054 922 / ACN 629 054 922) is the entity trading as In-Stock?, “Check Product Availability” mobile application.
- This Agreement is governed in all respects by the laws of New South Wales, Australia and you agree to submit to the exclusive jurisdiction of the Courts of that State (including the NSW District Registry of the Federal Court of Australia).
- The provisions of this Agreement are severable, and if any provision of this Agreement is held to be invalid or unenforceable, such a provision may be removed and the remaining provisions will be enforceable.
- This Agreement sets out the entire understanding and agreement between the User and In-Stock with respect to its subject matter.
- In-Stock may amend this Agreement at any time by posting amended terms on the Platform or website.
- Unless otherwise stated, all amounts and fees are quoted in Australian Dollars.
- In-Stock may assign its rights and obligations under this Agreement to another entity without your consent. In the event of an assignment, the User will remain bound by this Agreement.
- The headings in this Agreement are for reference purposes only and do not form part of this Agreement.
Glossary
- “Agreement” means the most updated version of the agreement between In-Stock and a User.
- “Agreed Price” means price agreed upon by the Customer and Service Provider for performance of a Stock Check or Place on Hold Task. This is currently $2 plus fees per individual check or hold and $4 plus fees for both tasks.
- “In-Stock?”, “In-Stock”, “we”, “us” or “our” means the legal entity Stockchecker Pty Ltd or trading as In-Stock?.
- “In-Stock Platform” means the In-Stock website at https://www.in-stock.com.au/, In-Stock? smartphone app, and any other affiliated Platform that may be introduced from time to time.
- “In-Stock Service” means the service of providing the In-Stock Platform.
- “Business Day” means a day on which banks are open for general business in Australia, other than a Saturday, Sunday or public holiday.

“Consequential Loss” means any loss, damage or expense recoverable at law:
- other than a loss, damage or expense that would be suffered or incurred by any person in a similar situation to the person suffering or incurring the loss, damage or expense; or
-
which is a loss of:
- opportunity or goodwill;
- profits, anticipated savings or business;
- data; or
- value of any equipment, and any costs or expenses incurred in connection with the foregoing.
- “Fees” means fees payable by Customers and Service Providers either through the Platform’s Payments System or an alternative payment system. Also may mean fees charged by the Platform independently or via Stripe the Payments System.
- “Loss” means any loss, damage or expense recoverable at law.
- “Payments System” means the system that Stockchecker Pty Ltd, trading as “In-Stock?” uses for the payment of Users subject to completion of Tasks, as described in Section “Payment Facility”.
- “Personal Information” has the same meaning given to it in the Privacy Act 1988 (Cth).
- “Policies” means the policies posted by In-Stock on the In-Stock Platform, including but not limited to the Privacy Policy.
- “Place on Hold Task” means a task posted on the Platform by a Customer requesting a Service Provider place an item on hold at a store.
- “Stock Check Task” means a task posted on the Platform by a Customer requesting a Service Provider check the availability of a particular product at a store.
- “Task” means a Place on Hold Task or Stock Check Task posted by a Customer on the In-Stock? Platform.
- “User” or “You” means the person who has signed up to use the In-Stock Platform, whether as the Customer, or Service Provider or both.
